1. PURPOSE

PLEASE READ THIS PRIVACY POLICY (THE "POLICY") CAREFULLY BEFORE USING THE BOUNTYJOBS.COM WEBSITE. BY USING THE WEBSITE, YOU AGREE TO BE BOUND BY THIS POLICY.

This Policy is incorporated by reference into the BountyJobs Terms of Service (the "Terms"). The terms "BountyJobs," "we," and "us" include BountyJobs, Inc. and our affiliates and subsidiaries. This Policy describes the type of information BountyJobs collects, what we do with that information, and how visitors can update and control the use of their information. As used in this Policy, Personal Information refers to any information that you provide to us that can be used to identify you or contact you directly. All other terms not defined in Section 14 or otherwise herein will have the meanings set forth in the Terms.

2. SCOPE

BountyJobs operates a web-based platform that features a marketplace of over 10,000 highly qualified agencies and a performance-based matching algorithm that helps hiring teams find and engage recruiters. This Policy applies to Personal Information that is Processed by BountyJobs in the course of our business, including on BountyJobs' website (the "Site"), mobile applications, forums, blogs, and other online or offline offerings (together with any and all future online and offline offerings operated by or on behalf of BountyJobs, the "Services"). All individuals whose responsibilities include the Processing of Personal Information on behalf of BountyJobs are expected to protect that data by adherence to this Policy.

BountyJobs protects information through other legally valid methods, including international data transfer agreements.

This Policy applies to all BountyJobs' operating divisions, subsidiaries, affiliates, and branches, and any additional subsidiary, affiliate, or branch of BountyJobs that we may subsequently form.

3. TRANSPARENCY/NOTICE — TYPES OF PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT

The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with BountyJobs and the requirements of applicable law. Some of the ways that BountyJobs may collect Personal Information from you include:

  • You may provide Personal Information directly to BountyJobs through interacting with the Services, participating in surveys, during events such as sweepstakes, and requesting Services, or information.
  • As you navigate the Services, certain passive information may also be collected about your visit, including through cookies and similar technologies as described below.

We endeavor to collect only that information which is relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.

3.1 Types of Personal Information We Collect

BountyJobs collects Personal Information regarding its current, prospective, and former Visitors, Employers, Headhunters, Candidates, guests, and Employees (collectively "Individuals").

  • Visitors. Those who visit our public-facing Website without having entered into a service agreement and created an account ("Visitors") may choose to request additional information from us. Visitors must then supply personal information such as their name, company name, email address, and phone number. This information is used for the purposes of contacting the Visitor and for ongoing marketing communications to the Visitor.
  • Employers. Those wishing to post jobs on the Website ("Employers") must supply personal information such as their name, company name, address, industry, company website, company size, company description, telephone number, fax number, email address, and financial information as necessary for payment and all other financial transactions with BountyJobs. BountyJobs will not share this information with any Third Parties with the exception of Headhunters who may be provided access to identifying information in the course of working with you on the Site and our Service Providers (Amazon Web Services, Domo, Hubspot, Microsoft, Box, and OpenAI) as described below.
  • Headhunters. BountyJobs may conduct background checks on individuals wishing to apply to BountyJobs to submit resumes of candidates ("Candidates") to Employers on the Site ("Headhunter Applicants"). Headhunter Applicants who are accepted by BountyJobs and become eligible to submit Candidates to Employers on the Website ("Headhunters"), will be required to provide additional information, such as name, company name, address, telephone number, fax number, email address, company website, company description, personal description, password, credit card information, and financial information as necessary for payments and all other financial transactions with BountyJobs.
  • Candidates. If you are a Candidate, a Headhunter will collect your name and email address along with your resume and any personally identifiable information contained therein and submit it to BountyJobs for data processing. We will only share your name and resume with an Employer when directed to do so by the Headhunter who is the data controller responsible for your information.
  • Automatic Data Collection. We may collect certain information automatically through our Services, such as your Internet protocol (IP) address, cookie identifiers, mobile carrier, mobile advertising identifiers, MAC address, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages visited, date and time of your visit, and other actions taken through use of the Services.

3.2 How BountyJobs Uses Your Information

We acquire, hold, use, and Process Personal Information about Individuals for a variety of business purposes, including:

  • To Provide Products, Services, or Information Requested. Fulfill requests for products, Services, or information; manage Individual information and Accounts; respond to questions, comments, and other requests; provide access to certain areas, functionalities, and features of BountyJobs' Services.
  • Administrative Purposes. Measure interest in BountyJobs' Services; develop new products and Services; ensure internal quality control; verify Individual identity; communicate about Individual Accounts and activities; process payment and transactions.
  • Marketing BountyJobs Products and Services. Provide you with materials about offers, products, and Services that may be of interest, including new content or Services. You may contact us at any time to opt out.
  • Research and Development. Create non-identifiable information for research and analysis purposes.
  • De-Identified and Aggregated Information Use. De-identified and aggregated information is not Personal Information, and BountyJobs may use such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes.

3.3 Cookies, Pixel Tags/Web Beacons, Analytics Information, and Interest-Based Advertising

We, as well as Third Parties that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies ("Technologies") to automatically collect information through the Services.

  • Cookies. Small text files placed in Visitors' computer browsers to store their preferences. If you do not wish to have cookies placed on your computer, you should set your browser to refuse cookies before accessing the Site.
  • Pixel Tags/Web Beacons. A piece of code embedded on the Site that collects information about users' engagement on that web page.
  • Social Media Widgets. Our Website includes social media buttons which may collect your IP address and set cookies. Your interactions with these features are governed by the privacy policy of the company providing them.
  • Analytics. We may use Google Analytics to collect information regarding visitor behavior and demographics. You can opt out at tools.google.com/dlpage/gaoptout.

3.4 Third-Party Websites and Social Media Platforms

The Site may contain links to other websites and other websites may reference or link to our Site. These other domains and websites are not controlled by us, and BountyJobs does not endorse or make any representations about Third-Party websites or social media platforms. We encourage our users to read the privacy policies of each and every website and application with which they interact.

3.5 Third-Party Payment Processing

We may sell virtual items or merchandise through our Services. When you make purchases through the Services, we process your payments through PayPal. PayPal may collect certain financial information from you to process a payment on behalf of BountyJobs.

4. HUMAN RESOURCES DATA

BountyJobs collects Personal Information from current, prospective, and former Employees, their contact points in case of a medical emergency, and beneficiaries under any insurance policy ("Human Resources Data"). We acquire, hold, use and Process Human Resources Data for a variety of business purposes including workflow management, HR administration, payroll, benefits, performance management, and regulatory compliance.

5. ONWARD TRANSFER — BOUNTYJOBS MAY DISCLOSE YOUR INFORMATION

5.1 Information We Share

We may share your information as described in this Privacy Policy or with your permission, including:

  • Resumes. Headhunters may share Candidate resumes with Employers through the Site. We will not sell, rent, or distribute any resume without the consent of the Headhunter who submitted it.
  • Vendors and Service Providers. We may share information with vendors and service providers for IT, customer service, payment processing, and fraud prevention.
  • Business Partners. BountyJobs may share Personal Information with business partners and affiliates for internal business purposes.
  • Disclosures to Protect Us or Others. We may access, preserve, and disclose your Personal Information to comply with law enforcement, respond to your requests, or protect rights, property, or safety.
  • Merger, Sale, or Other Asset Transfers. Your information may be sold or transferred as part of a merger, acquisition, or sale of company assets.

5.2 International Data Transfers

You agree that all Personal Information collected via or by BountyJobs may be transferred, Processed, and stored anywhere in the world, including but not limited to, the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers.

6. OPT-OUT (RIGHT TO OBJECT TO PROCESSING)

You have the right to object to and opt out of certain uses and disclosures of your Personal Information. Where you have consented to BountyJobs' Processing of your Personal Information, you may withdraw that consent at any time by contacting privacy@bountyjobs.com.

  • Email and Telephone Communications. If you receive an unwanted email from us, you can use the unsubscribe link to opt out. We process do-not-call and do-not-mail requests within 60 days.
  • Mobile Devices. You may opt out of push notifications and location-based information collection by changing the settings on your mobile device.
  • "Do Not Track". Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
  • Cookies and Interest-Based Advertising. You may stop or restrict cookies by adjusting your web browser preferences. You can opt out of targeted advertising at networkadvertising.org or aboutads.info/choices.

7. YOUR PRIVACY RIGHTS

For purposes of the California Consumer Privacy Act, BountyJobs does not "sell" your Personal Information. In accordance with applicable law, you may have the right to: (i) inquire as to whether BountyJobs is Processing Personal Information about you; (ii) request access to Personal Information; (iii) receive an electronic copy of Personal Information that you have provided to us ("right of data portability"); (iv) ask that we correct or rectify your Personal Information; and (v) request erasure of Personal Information held about you by BountyJobs.

You may send an e-mail to privacy@bountyjobs.com to exercise your rights. Please include your full name, email address associated with your Account, and a detailed description of your data request.

8. DATA RETENTION

BountyJobs retains the Personal Information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

9. SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

10. INTERNATIONAL USERS

By using the Site, BountyJobs will transfer data to the United States. By choosing to visit the Site, utilize the Services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Policy will be governed by the laws of the United States.

11. CHILDREN'S PRIVACY

Our Services are not directed to children under 13 and we do not knowingly collect Personal Information from children under 13. If you learn that your child has provided us with Personal Information without your consent, you may alert us at privacy@bountyjobs.com.

12. REDRESS/COMPLIANCE AND ACCOUNTABILITY

If you have any questions about our privacy practices, this Policy, or how to lodge a complaint with the appropriate authority, please contact BountyJobs by email at privacy@bountyjobs.com. We will address your concerns and attempt to resolve any privacy issues in a timely manner.

13. OTHER RIGHTS AND IMPORTANT INFORMATION

13.1 Changes to Our Privacy Policy and Practices

This Privacy Policy may change from time to time. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you use the Services after the updated Privacy Policy is posted on the Services. We will post any adjustments to the Privacy Policy on this web page, and the revised version will be effective immediately when it is posted.

13.2 California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the Third Parties to whom we have disclosed their Personal Information (if any) for their direct marketing purposes in the prior calendar year. Except as otherwise provided in this Privacy Policy, BountyJobs does not share Personal Information with Third Parties for their own marketing purposes.

13.3 Compliance

This Policy shall be implemented by BountyJobs and all its operating divisions, subsidiaries and affiliates. BountyJobs has put in place mechanisms to verify ongoing compliance with this Policy.

14. DEFINITIONS

  • "Agent" means any Third Party that Processes Personal Information pursuant to the instructions of, and solely for, BountyJobs.
  • "Employee" refers to any current, temporary, permanent, prospective or former employee, director, contractor, worker, or retiree of BountyJobs or its subsidiaries worldwide.
  • "Personal Information" is any information relating to an identified or identifiable natural person ("Individual").
  • "Process" or "Processing" means any operation which is performed upon Personal Information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available.
  • "Sensitive Data" or "Sensitive Personal Information" is a subset of Personal Information which, due to its nature, has been classified by law or by policy as deserving additional privacy and security protections.
  • "Third Party" is any company, natural or legal person, public authority, agency, or body other than the Individual, BountyJobs or BountyJobs' Agents.
